A consumer is any natural person entering into a legal transaction primarily for purposes outside their trade, business or profession.

Any terms and conditions used by the customer shall apply only if we have expressly agreed to them.

2. Contracting party and conclusion of contract

The sales contract is concluded with Automaten Richter, owned by Birgit Richter.

Product listings in our online shop are invitations to place an order and do not constitute binding offers.

Customers may add products to their shopping cart without obligation and correct their entries before submitting an order. By clicking the button that submits the order with an obligation to pay, the customer makes a binding offer to purchase the goods in the cart.

An automatic email confirms receipt of the order. Unless it expressly states that the order has been accepted, this email confirms receipt only.

The contract is concluded when we expressly accept the order, for example by sending an order confirmation, or when the goods are dispatched.

The contract language is German. Any English version of these Terms is provided for information. In the event of discrepancies, the German version shall prevail.

3. Order details and corrections

Before submitting an order, customers can review and correct their entries and selected products. The available correction options are displayed during checkout.

We store order information in accordance with applicable legal requirements. Order details and these Terms may be provided electronically with the order confirmation.

4. Prices and shipping costs

All prices are stated in euros and include statutory VAT where applicable. Additional shipping charges are displayed in the online shop and during checkout.

The conditions on our Shipping Information and Costs page apply to deliveries. The rates and conditions stated there for the relevant destination and order shall apply.

For deliveries to countries outside the relevant VAT territory, import duties, taxes or other charges may apply. Where legally applicable, these charges are payable by the customer.

5. Payment

The payment methods offered by our online shop are:

  • PayPal

  • Advance payment by bank transfer

  • Cash on delivery, subject to an additional fee

  • Cash payment on collection at our business premises

For advance payment, the customer must transfer the invoice amount according to the instructions in the order confirmation. Unless otherwise agreed, goods will be dispatched after payment has been received.

When PayPal is selected, payment is processed through PayPal. PayPal’s terms and privacy information also apply.

For cash on delivery, the invoice amount is collected when the parcel is delivered. An additional fee applies to this payment method. The amount of the fee is displayed to the customer before the order is placed.

Cash payment is available exclusively for personal collection at our business premises by prior arrangement. Collection must be agreed with us in advance; purchases without a prior arrangement are not offered.

We reserve the right to restrict the available payment methods to the extent permitted by law.

6. Delivery and availability

Goods are delivered to the address specified by the customer unless otherwise agreed.

Delivery estimates, shipping charges and any destination-specific restrictions are set out on our Shipping Information and Costs page. Unless expressly agreed as binding, delivery times are estimates.

If an ordered item is unexpectedly unavailable and we cannot fulfil the contract as agreed, we will inform the customer without undue delay. Payments already received for goods that cannot be delivered will be refunded in accordance with applicable law.

The customer’s statutory rights in the event of delayed delivery remain unaffected.

7. Retention of title

Goods remain our property until the purchase price has been paid in full.

In transactions with businesses, title remains with us until all claims arising from the ongoing business relationship have been settled, to the extent permitted by law.

8. Right of withdrawal for consumers

Consumers generally have a statutory right of withdrawal. Details regarding the withdrawal period, requirements, returns, refunds and statutory exceptions are set out in our separate Right of Withdrawal notice.

The right of withdrawal does not apply where a statutory exception is actually applicable to the relevant contract. Only the statutory requirements and restrictions apply.

Our withdrawal information forms part of the pre-contractual information provided to consumers but does not replace applicable legislation.

9. Statutory liability for defects

Statutory rights in respect of defective goods apply.

For consumers, statutory limitation periods and rules on the burden of proof apply. Deviations are agreed only where permitted by law and where the relevant legal requirements are met.

For business customers, statutory rules apply subject to any legally permissible deviations. Mandatory statutory provisions, including those concerning fraudulent concealment of a defect or an expressly given guarantee, remain unaffected.

A manufacturer’s warranty applies only if expressly stated for the relevant product. Such a warranty does not restrict the customer’s statutory rights against us.

10. Liability

We are liable without limitation for intent and gross negligence, and for damage resulting from injury to life, body or health.

In cases of slight negligence involving a material contractual obligation, our liability is limited to the foreseeable damage typical for the contract. Material contractual obligations are those whose performance is essential to the proper fulfilment of the contract and on which the customer may reasonably rely.

Otherwise, liability for damage caused by slight negligence is excluded to the extent permitted by law.

Liability under applicable product liability legislation and liability under an expressly given guarantee remain unaffected. These provisions also apply for the benefit of our legal representatives and agents.

11. Customer reviews

Customer reviews provide information about products and their use. Information on how reviews are collected and checked is available on our Customer Reviews page.

We do not claim that every review has been individually verified against a completed purchase unless such verification has actually taken place.

12. Vouchers

12.1 Purchased gift vouchers

Purchased gift vouchers may be redeemed for products offered by our shop, subject to the applicable redemption conditions. Conditions communicated at the time of purchase apply where they have been validly agreed and comply with applicable law.

Claims arising from paid gift vouchers are generally subject to statutory limitation rules. Unless a different provision has been validly agreed, the regular limitation period is three years and generally begins at the end of the year in which the claim arose and the other statutory requirements are met.

These Terms do not impose a blanket reduction of the statutory limitation period or automatic forfeiture of any remaining voucher balance.

12.2 Partial redemption

If the value of a voucher exceeds the value of an order, the unused balance generally remains available for a future redemption. Statutory limitation rules and validly agreed redemption conditions remain unaffected.

Cash redemption is excluded unless required by law or otherwise agreed.

12.3 Free promotional vouchers

Separate conditions may apply to free promotional or discount vouchers, including an expiry date, minimum order value or restrictions to certain products. Such conditions are communicated when the voucher is issued and apply only to the extent legally valid.

13. Batteries and electrical equipment

Information about returning used batteries, disposing of electrical and electronic equipment and any applicable take-back obligations is available in the relevant notices on our website.

Batteries and electrical equipment must not be disposed of with household waste where separate collection is required by law. Please follow the relevant product and disposal instructions.

14. Data protection

Information about the processing of personal data, the technical services used and the rights of data subjects is available in our Privacy Policy.

15. Dispute resolution

We are generally neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board, unless we expressly state otherwise in an individual case.

The former EU Online Dispute Resolution (ODR) platform is no longer offered as a dispute resolution route.

16. Governing law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG), to the extent that this exclusion is legally permissible.

For consumers, this choice of law applies only insofar as it does not deprive them of protection afforded by mandatory provisions of the law of their habitual residence.

For merchants, legal entities under public law and special funds under public law, the courts at our registered business location shall have jurisdiction to the extent permitted by law.

17. Final provisions

If any provision of these Terms is or becomes invalid, the applicable statutory provisions shall apply. The invalidity of one provision does not automatically invalidate the remaining provisions.
